Simovy.com, 5651 sayılı yasanın 5. maddesinde tanımlanan ''yer sağlayıcı'' olarak hizmet vermektedir. İlgili yasaya göre, web sitesi yönetiminin hukuka aykırı içerikleri kontrol etme yükümlülüğü yoktur. Bu sebeple, sitemiz ''talep et ve kaldır'' prensibi ile hareket etmektedir. Telif hakkına konu olan tüm eserlerin yasal olmayan bir biçimde paylaşıldığını ve yasal hakların çiğnendiğini düşünen hak sahipleri ve meslek birlikleri, e-posta adresimiz üzerinden tarafımıza ulaşabilir. Tarafımıza bildirilen istek, talep ve ilgili şikayetler hukuksal olarak mercek altına alınacak ve gerek görülmesi halinde derhal yayından kaldırılacaktır.

MADDE 5 (1): Yer sağlayıcı, yer sağladığı içeriği kontrol etmek veya hukuka aykırı bir faaliyetin söz konusu olup olmadığını araştırmakla yükümlü değildir.

MADDE 5 (2): Yer sağlayıcı, yer sağladığı hukuka aykırı içerikten, ceza sorumluluğu ile ilgili hükümler saklı kalmak kaydıyla, bu Kanunun 8'inci ve 9'uncu maddelerine göre haberdar edilmesi halinde ve teknik olarak imkan bulunduğu ölçüde hukuka aykırı içeriği kaldırmakla yükümlüdür.

Simovy.com serves as a ''location provider'' defined in Article 5 of Law No. 5651. According to the revelant law, the website managemet has no obligation to control illegal content. For this reason, our site operates with a 'request and remove' section. All copyrighted products are shared illegally and can be easily reached through our e-mail address by joining with rights holders and industries that think legal rights have been violated. Request and complaints sent to us will be legally filed and will be removed from publication if maintained.

RELEVANT LAW:
ARTICLE 5 (1): The hosting provider is not obliged to control the content if provides or to investigate whether there is an illegal activity.

ARTICLE 5 (2): The hosting provider is obliged to remove the illegal content from the publication if it is notified of the illegal content it provides, in accordance with Articles 8 and 9 of this Law, and to the extent technically possible, without prejudice to the provisions regarding criminal liability.
